Schedule an appointment to fill out a Firearms Transaction Record Form, Background Check, and any other processes that must be completed before gaining possession of your firearm.  There is a MINIMUM of 10 business day waiting period on all pistols, revolvers and semi-automatic firearms.  This waiting period can extend up to 30 days and longer depending on the response from your local law enforcement agency.  This waiting period is NOT controlled by the Auctioneer.  If the waiting period extends past 30 days, you as the buyer must come back to our location and re-submit all licensing documents.

BUYER'S PREMIUM: A buyer's premium of 15% of the high bid will be added to the high bid to determine the final sales price for the auction lot. Example: $100 bid + $15 BP = $115 invoice amount

REMOVAL: Friday, October 14th, Monday, October 17th, Tuesday, October 18th - Time will be sent out with times to sign up to pick up.

PAYMENT: All buyers must pay for their purchases in full by Tuesday, October 18th2022. Estate Details dba of Musser Bros, Inc accepts the following forms of payment:

• Cash

• E-Checks

• All major credit cards subject to 3.5% convenience fee

Payment must be made by Tuesday, October 18th2022.

NO RESERVES. Each lot will sell to the highest bidder without reserve unless noted otherwise.

NO BUYBACKS. All sellers are contractually prohibited from bidding on lots they have consigned to the auction.

NO RETURNS. All sales are final. There are no returns, refunds, credit card chargebacks, or adjustments.

AUCTION ENDING. Beginning at the stated closing time, the auction software will conclude bidding for one or more lots each minute in catalog order with the following exception: if a bid is placed within 30 seconds or less remaining for that lot, bidding for that lot will reset for 30 seconds or until 30 seconds pass without any further bid advances.

FIREARMS. All applicable gun laws will be observed. All buyers must complete ATF Form 4473 in person, show government issued ID, and FBI background check will be performed before possession of a firearm will be transferred to the buyer. Alternatively, if a buyer is having their firearm shipped, it must be shipped to a FFL.  If the buyer is unable to take possession of the firearm, the buyer's premium will be forfeited. (If you cannot pass the background check, please do not bid on firearms). Some firearms may not be legal in bidder's jurisdiction.  It is the bidder's sole obligation to determine if a firearm they purchase is legal where they live.  Magazines that are not legal where a buyer lives are not included in the sale.  No credit will be given for the magazine. 

CONDITION OF FIREARMS. Auctioneer makes no warranties or representations whatsoever and no employee or consultant of auctioneer has the authority to do otherwise, concerning the operation of but not limited to firing condition, fitness for use, safety to store, or reliability, of any firearm, ammunition, or parts. Use of any firearm or ammunition purchased at Auctioneer is entirely at the user’s risk. Auctioneer offers for sale the lots as “collector” lots only. Auctioneer strongly recommends that all weapons, ammunition, etc. purchased at auction be examined by a competent gunsmith. Auctioneer expressly disclaims any liability whatsoever for accident, injury or damage resulting to any person from the storage or subsequent use of any such lot.

OUT-OF-STATE BUYERS.  By Federal Law, firearms can only be shipped to an FFL Holder. If you do not have an FFL, you must make arrangements with an FFL Holder in your state to handle the transfer. Please contact an FFL holder before placing a bid to make sure you qualify. Some firearms may not be legal in all locations.  NO FIREARM SALES TO CALIFORNIA or ILLINOIS RESIDENTS. Know your local laws.

IN-STATE BUYERS. No one except the registered bidder is allowed to pick up a firearm. Government-issued ID must reflect the current address of residence.

SHIPPING OF FIREARMS. All firearms must be shipped to an FFL (Federal firearm Licensee) of the buyer's choosing, FFLs are fairly easy to find (most gun shops will do this for you), and most charge a nominal fee for this service. A shipping and handling fee will be assessed to the buyer. The receiving FFL will then perform the transfer of the firearm to the buyer including any required background checks, the buyer is responsible for any fees assessed by his/her FFL. An adult signature will be required for the receipt of any firearm that is shipped.

• Shipping costs $25 per firearm for materials & handling PLUS the cost of shipping.

SHIPPING OF OTHER ITEMS.  We can ship other items that will fit in a 14 x 14 x 14 box. We cannot ship powder.

OUTBID NOTIFICATION. Until the auction begins to close, the bidding software will notify bidders by email when they have been outbid.

PICKUP LOCATION & TIMELINE EXCLUDING FIREARMS. Most items can be picked up at 3125 Rickenbacker Drive, Pasco WA 99301. No items are to be removed until payment has been received by the auction company. Pickup will be by scheduled appointment only. Any items left after the specified pickup items will be considered forfeited unless alternate pickup or shipping arrangements are made. 

Items not removed by the allotted pick-up time and have scheduled a later pick-up will have a minimum charge of $10 per lot, per day added. The items may be forfeited to Estate Details dba of Musser Bros. Inc if we have not been told of a later pickup time. There is a minimum charge of $50-200 to open the property at any other time if it had not been scheduled before or if the property was not open at the time. Bidder should arrange to pick up his/her purchases within the pickup time allotted.

If items are not removed within the time schedule posted above, Estate Details dba of Musser Bros. Inc. reserves the right to resell the items and retain all sales proceeds as payment for accumulated, unpaid storage and handling. Merchandise becomes the full responsibility of the bidder at the time of payment and the bidder assumes all risk of loss and damage to property at that time. In any such event, the bidder will still be responsible for payment for the original purchase and the costs of collection of this payment and/or damages resulting from the resale of the property.

DEBT COLLECTION and INTEREST CHARGES. The bidder agrees to pay all reasonable attorney fees and other costs incurred by Estate Details dba of Musser Bros, Inc, in its efforts to collect unpaid funds from the bidder. The bidder agrees that a fee of 2% of the outstanding balance per month is added to any unpaid balance due to Estate Details dba of Musser Bros, Inc. Any debt collection or dispute proceedings will be heard in Benton County, Washington.

GUARANTY AGREEMENT. By submitting a bid in the name of a business entity or corporation, the individual submitting the bid enters into a guaranty agreement whereby he or she personally guarantees payment to Musser Bros, Inc, of any bid amount not paid when due by the business entity or corporation, for any reason, together with all collection expenses incurred to enforce collection, including a reasonable attorney's fee.

LIMITATION OF LIABILITY. If, for any reason, Musser Bros, Inc, is unable to make available or deliver any Purchase, or portion thereof, or documentation required in respect of any Purchase, the sole liability of Musser Bros, Inc, if any, shall be the return of monies paid in respect of such purchase upon its return by Purchaser.

DISCLAIMER. All lots sell as is, where is, with all faults. Estate Details dba of Musser Bros, Inc and the seller do not give or make any type of guarantee or warranty regarding the lots to be sold, implied or otherwise. Estate Details dba of Musser Bros, Inc encourages all bidders to inspect lots in person before bidding. Estate Details dba of Musser Bros, Inc is not responsible for incorrect listing information, if any. Estate Details dba of Musser Bros, Inc has attempted to provide accurate descriptions of all items, however, it is the bidder's responsibility to determine the condition and suitability of each lot. Printed statements or descriptions by Estate Details dba of Musser Bros, Inc staff are provided in good faith and are matters of opinion.

AGE REQUIREMENT. All bidders must be 21 years of age or older.

BIDDER INFORMATION AND SECURITY. All registration information the bidder provides to Estate Details dba of Musser Bros, Inc, shall be current, complete, and accurate. All bidders are responsible for any bids placed under their bidding numbers and passwords. The security of bidder information is the responsibility of the bidder. Bidders must notify Estate Details dba of Musser Bros, Inc if they believe that their bidder number and password have been compromised.

SERVER & SOFTWARE TECHNICAL ISSUES. In the event there are technical difficulties related to the server, software or any other online auction-related technologies, Estate Details dba of Musser Bros, Inc. reserves the right to extend bidding, continue the bidding, or close the bidding. NEITHER THE COMPANY PROVIDING THE SOFTWARE nor Estate Details dba of Musser Bros, INC. SHALL BE HELD RESPONSIBLE FOR A MISSED BID OR THE FAILURE OF THE SOFTWARE TO FUNCTION PROPERLY FOR ANY REASON. Email notifications will be sent to registered bidders with updated information as deemed necessary by Estate Details dba of Musser Bros, Inc.
